Jo Kaucher prevents Teaching Assistant from being barred by DBS
Jo Kaucher successfully made detailed representations to the Disclosure & Barring Service (DBS), ensuring her client was not included on the Children’s Barred List.
Jo’s client, a dedicated teaching assistant in a primary school, faced allegations of physical and emotional harm toward a vulnerable 7-year-old child with Downs Syndrome. The child, who was pre-verbal and working at the developmental age of 12-18 months, was central to the case.
Following a police investigation, no further action was taken regarding the allegations of physical harm. Building on this outcome, Jo’s representations to the DBS focused on the principles of proportionality and necessity, carefully balancing public protection with the rights of her client.
Jo argued that barring her client was disproportionate given their long, unblemished career in the educational sector and the extremely low risk of repetition. Thanks to Jo’s robust representations, her client can now continue contributing to the educational field without any significant career obstacle.
