Lucinda Shand Secures Dismissal of Interim Suspension Order at HCPC Hearing

Lucinda Shand, in collaboration with Julia Flanagan of Crucible Chambers, successfully represented a healthcare professional facing an 18-month interim suspension order sought by the Health and Care Professions Council (HCPC). The suspension, if granted, would have prevented the professional from continuing their prominent hospital role while fitness-to-practice concerns were investigated.

Lucinda meticulously prepared the case, collating extensive supporting evidence and submitting a detailed bundle ahead of the hearing. During proceedings, Counsel effectively challenged the HCPC’s evidence, highlighting inconsistencies and weaknesses in the investigation. It was argued that the test of necessity for imposing an Interim Suspension Order had not been met.

After thorough consideration, the Panel determined that the contradictory and unsubstantiated evidence presented by the HCPC and challenged by Counsel did not justify the imposition of an interim suspension order or interim conditions. Consequently, no action was taken, allowing Lucinda’s client to continue their vital role in the health service without restriction.
